End User Licence Agreement

Friends RSVP is pre-release software. Features may change, break, or be removed without notice, and data may be lost or corrupted. Do not rely on it as the only record of an event, and do not use it for anything where a missed message or a lost reply would cause real harm. Keep your own copy of anything important. There is no warranty and no guarantee of availability, and there is no guarantee of uptime or recoverability. Once the service is generally available these terms will be updated and this notice removed.

1. What this licence covers

This agreement is between you and the operator of Friends RSVP ("we", "us") and covers the Friends RSVP software you are using right now: the application, its interface, its designs and templates, and any updates we make available (together, the "Software").

It does not cover the content you create with it. Your event details, guest messages, and wishlist entries remain yours — see section 4. It also does not replace the Terms of Service, which govern your use of the service itself.

2. Licence granted to you

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Software through its interface, for the purpose of creating and responding to invitations. This licence is free of charge for the features that are free, and covered by your subscription for the features that are not.

The Software is licensed, not sold. We and our licensors keep all rights, title, and interest in it. No rights are granted except those written in this agreement.

3. What you may not do

When using the Software, you must not:

  • access, or attempt to access, any part of it you were not given access to — including other people's events, other people's accounts, and any administrative or staff area;
  • probe, scan, or test its security, or attempt to bypass its rate limits, bot protection, or authentication, without our written permission first;
  • scrape, harvest, or bulk-extract content, guest lists, email addresses, or phone numbers from it;
  • copy, modify, translate, or create derivative works from it, or reverse-engineer or decompile it, except to the extent that restriction is not permitted by law;
  • resell it, white-label it, run it as your own service, or make it available to third parties as a service;
  • remove or obscure any copyright, trademark, or attribution notice; or
  • use it to break the law, to harass or defraud anyone, or to send unsolicited bulk email or text messages.

Attempting to bypass protections is a breach of this licence and may also be a criminal offence. If you believe you have found a security problem, tell us at the address in section 12 instead of testing it — we would much rather hear about it than discover it.

4. Pre-release software — important

The Software is under active development, is not finished, and is provided for evaluation.

You are using a pre-release version. That has real consequences, and by using it you accept them:

  • It may break. Features may be broken, incomplete, or behave inconsistently. Things that work today may not work tomorrow.
  • It may stop working entirely. We may take the service offline, suspend it, or discontinue it — temporarily or permanently — at any time, without notice and without liability to you.
  • Data may be lost. Events, replies, guest lists, bring lists and wishlists may be lost, corrupted, or reset, including as a result of our own updates, testing, or maintenance. We do not promise to keep backups, and there may be no way to restore what is lost.
  • Features may change or disappear. Anything described anywhere may be renamed, changed, or removed without notice. Free features may later require payment.
  • Messages may not arrive. Invitation emails and text messages may fail, be delayed, or be rate-limited.
  • Keep your own copy. Do not treat Friends RSVP as the only record of an event. Keep your guest list and any details that matter to you somewhere else as well.
  • Do not rely on it for anything critical. Do not use it where a missed message, a lost reply, or an outage could cause real harm or financial loss.

If you are paying for a subscription while the service is pre-release, you should understand that you are paying for early access to a product still being built, and not for a product with a promised level of reliability. You may cancel at any time — see the Terms of Service for how, and for our refund policy. If the service is discontinued permanently, we will stop billing you.

5. Your content stays yours

We claim no ownership of the event details, designs you choose, messages, or lists you create. You grant us only the permission we need to store, process, transmit, and display that content in order to run the service — including sending it to the service providers named in the Privacy Policy. That permission ends when you delete the content, apart from copies kept in backups or retained as the law requires.

6. Third-party components and services

The Software is built on third-party and open-source components, and relies on third-party services to operate — email delivery, text messaging, payment processing, and hosting. Those components and services are governed by their own licences and terms, and we are not responsible for them. Your use of a third-party service (for example, paying through our payment processor, or buying from a retailer through a gift link) is between you and that provider.

7. Support

We do not promise any level of support, response time, or availability. Any help we give is offered as a courtesy and on a best-effort basis. There is no service-level agreement, and nothing in this agreement creates one. Section 4 above explains why you should not depend on the service while it is pre-release.

8. Feedback

If you send us ideas, suggestions, or bug reports, we may use them without restriction or obligation to you. Please do not send us anything you consider confidential or that you want to be paid for.

9. Ending this licence

This licence lasts while you use the Software and ends automatically if you break it. We may also suspend or end your access as described in the Terms of Service. When it ends, you must stop using the Software; sections that by their nature should survive — including sections 5, 6, 8, and 10 to 12 — continue to apply.

10. No warranty

The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Software will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that it will meet your requirements. This is especially true while the Software is pre-release, as section 4 explains. Nothing in this agreement excludes a warranty or right that cannot be excluded under the law that applies to you.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of or relating to the Software or this licence — whether the claim is in contract, tort, or otherwise, and even if we were told such damage was possible.

Our total liability under this agreement is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty US dollars. This does not limit liability that cannot be limited by law, and it does not affect consumer rights you have where you live.
